General Data Protection Regulations (“GDPR”) Privacy Notice and Information for Clients
The GDPR are important European regulations, which have introduced amendments to data protection law including introducing additional rights for individuals in relation to their personal and sensitive personal data. GDPR applies to all EU Member States from 25 May 2018.
Avita Legal Ltd are committed to protecting and keeping confidential all the information you provide to us, subject to certain legal duties that are explained in our terms and conditions of business.
We ask that you read this privacy notice carefully as it contains important information about who we are, how and why we collect, store, use and share personal information, your rights in relation to your personal information and how to contact us and supervisory authorities in the event you have a complaint.
Who we are
Avita Legal is a trading style of Avita Legal Ltd. It is a Limited Company registered in England, company number 14091623. The registered office is at 115 – 125 Bradshawgate, Bolton, BL2 1BJ. It is a legal practice, which is authorised and regulated by the Solicitors Regulation Authority under number 8000842. The firm collects, uses and is responsible for certain personal information about you. When it does so, it is also regulated under the GDPR by the Information Commissioner and is responsible as ‘controller’ of that personal information.
The personal information we collect, use and share
In the course of your legal transaction, we collect the following personal information when you provide it to us:
- Name, address, date of birth, contact information (telephone and email where appropriate), National Insurance number (where appropriate)
- Identity information and documentation
- Additional information in relation to your legal transaction to enable us to advise you and progress your case. This will depend on the type of legal work you instruct the firm to undertake
We use your personal information primarily to enable us to provide you with a legal service in accordance with your instructions. We also use it for related purposes including identity verification, administration of files, updating existing records, analysis for management improvement, statutory returns, and legal and regulatory compliance. The information will be held in hard copy and/or electronic format.
You are responsible for ensuring the accuracy of all the personal data you supply to us, and we will not be held liable for any errors unless you have advised us previously of any changes in your personal data.
We will only take instructions from you or someone you authorise in writing.
Where you are acting as an agent or trustee, you agree to advise your principal or the beneficiary of the trust that their personal information will be dealt with on these terms.
If we are working with other professionals advising you (experts, barristers, lenders, etc.), we may share relevant data unless you notify us otherwise.
We sometimes use trusted external providers for support tasks. Confidentiality agreements ensure security. All routine tasks are handled in-house.
We use secure computing systems. IT providers are subject to confidentiality and GDPR compliance. Your information is kept in the UK unless you instruct otherwise.
We may be legally required to share personal information with authorities. In such cases, we might not be able to inform you or continue working on your matter.
Some files may be confidentially audited or reviewed by professional bodies or directories. We assume consent unless you object. Sensitive material will not be shared.
We will not share your data with third parties or the media without your explicit consent.
How long your personal data will be kept
We retain your data and file for a period based on your case. Details will be confirmed at case end. Files will be securely destroyed afterward unless other arrangements are made.
Basic details (name, address, DOB) may be held longer for regulatory purposes.
